In 1890, a 1/8 African-American & 7/8 white named Homer Plessy went on to a train that was for "White" only. When he was asked to move, he didn't and got arrested.  He had challeged the local law. At the court, he aruged that Louisiana's Separate Car Act violates 14th Amendment, which was about no slavery and equal protection. But on the Supreme Court, the judges argued that separating based on race does not count as violating rights. He lost the case which then the decision was "Separate but equal". And so the states are allow to pass segregation laws. This decision was a setback for African American rights because the decision had made even worst for them when the Supreme Court saids separate races does not take away civil rights and states may pass more laws like this.
